Please read these terms carefully as they serve as a contract between us and provide important information regarding your legal rights, remedies, and obligations.
The goal of Mbtelm.com is to improve lives through learning. These terms apply to all activities on Mbtelm.com, its mobile applications, and other related services ("Services").
You need an account for most activities on our platform. Keep your password secure, as you are responsible for all activities associated with your account. If you suspect that others are using your account, please inform us and contact our technical team. You need an account for most activities on our platform, including purchasing and accessing courses or submitting courses for publication. When setting up and maintaining your account, you must provide accurate and complete information, including a valid email address, and continue to provide this information. You are fully responsible for your account and everything that happens in your account, including any harm or damage (to us or anyone else) resulting from others using your account without your permission. This means you should be cautious in maintaining your password. You are not allowed to transfer your account to someone else or use someone else's account. If you contact us to request access to an account, we will not grant you access unless you can provide the necessary information to prove account ownership. In the event of the user’s death, the account will be closed. You are not allowed to share your account login information with anyone. You are responsible for any activities that occur with your account, and Mbtelm.com will not intervene in disputes between students or instructors who have shared account login information. You must immediately notify us if you become aware that someone may be using your account without your permission (or if you suspect any other security breach) by contacting our technical team. We may ask you for some information to verify that you are indeed the owner of your account.
When you enroll in a course or another course, you receive a license from us to view it through the Mbtelm.com services. Do not attempt to transfer or resell the course in any way. We typically grant you a lifetime access license unless we are required to deactivate the course for legal reasons (our policy).
According to our instructor terms, when a course is published on Mbtelm.com, the instructor grants Mbtelm.com a license to provide access to that course for students. This means we have the right to sublicense the course to enrolled students. As a student or learner, when you enroll in a course, whether it is free or paid, you receive a license from Mbtelm.com to view the course through the Mbtelm.com platform and services. The course is licensed to you and is not sold to you. This license does not grant you any right to resell the course in any form (including sharing account information with a buyer or illegally adding the course and sharing it on other sites).
In legal and more precise terms, Mbtelm.com grants you (as a student or learner) a limited, non-exclusive, non-transferable license to access and view the course for which you have paid all required fees, solely for personal, non-commercial educational purposes through our services in accordance with these terms and any specific conditions or restrictions related to the particular course or service features. All other uses are expressly prohibited. You are not permitted to reproduce, redistribute, transfer, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works from, sublicense, or in any other way transfer or use any course without our explicit permission. This also applies to any course you may access through any of our APIs.
We typically grant our students lifetime access when they enroll in a course. However, we reserve the right to revoke any license for access and use of any course at any time if we decide or are required to deactivate access to the course for legal or policy reasons. For example, if another course you are enrolled in is subject to a copyright complaint, or if we determine that the content violates our trust and safety guidelines. This lifetime access license does not apply to enrollments made in subscription plans or to additional features and services related to the course you are enrolled in. For example, instructors may choose at any time to discontinue any educational services or Q&A related to the course. Clearly, lifetime access pertains to the course content, not to the instructors.
Instructors cannot directly grant licenses for their courses to students and learners, and any direct licensing in this regard will be null and void and in violation of these terms.
When you make a payment, you agree to use a valid payment method.
Course prices on Mbtelm.com are determined based on the instructor agreement terms and our promotional policies. In some cases, the course price listed on the Mbtelm.com website may not exactly match the price offered in our mobile apps or TV services due to pricing systems and policies of mobile platform providers regarding sales and promotions.
We occasionally run promotions and sales for our courses where some courses are available at discounted prices for a limited time. The price applied to the course will be the price at the time of purchase (at the checkout stage). Any price offered for a specific course may also differ from the price available to users who are not logged in or registered, as some promotions are only available to new users.
If you are logged into your account, the currency you see will be in Afghani. We do not allow users to view pricing in other currencies.
You agree to pay the fees for the course you purchased and authorize us to charge your debit or credit card or use other payment methods (such as mobile wallets) for these fees. Mbtelm.com collaborates with payment service providers to offer the most convenient payment methods in the country and to keep your payment information secure. We may share your payment methods using information provided by the payment service providers.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still have access to the course you enrolled in, you agree to pay the applicable fees within 30 days of our notice. We reserve the right to deactivate access to any course for which we have not received sufficient payment.
Mbtelm.com or our partners may offer discounts and promotions to students. Some of these codes may be applicable for gift or promotional credits applied to your Mbtelm.com account and can then be used for eligible course purchases on our platform, subject to the terms associated with your codes. Other codes may be directly applicable to specific courses. Discount and promotional credits cannot be used for purchases made in mobile apps.
These credits, as well as any promotional value associated with them, may expire if not used within the specified time frame in your Mbtelm.com account. Discount and promotional codes provided by Mbtelm.com may not be converted to cash unless stated otherwise in the terms associated with your codes or under applicable law.
You may only use Mbtelm.com for lawful purposes. You are responsible for all content that you publish on our platform. You must keep your comments, questions, posts, courses, and any other content you add in compliance with our trust and safety guidelines and the law, and respect the intellectual property rights of others. We may block your account for repeated or serious violations. If you believe someone is infringing your copyright on our platform, please inform us.
You cannot use the services or create an account for unlawful purposes. Your use of the services and your conduct on our platform must comply with local or national laws and regulations. You are solely responsible for being aware of and complying with such laws and regulations that apply to you.
If you are a student or learner, the services allow you to ask questions of the instructors of the courses you are enrolled in and to post comments about the courses. For some courses, the instructor may invite you to submit a course as an "assignment" or exam. Do not publish or submit anything that does not belong to you.
If you are an instructor, you can offer a course for publication on the platform and also communicate with students who are enrolled in your courses. In both cases, you must comply with the rules and respect the rights of others: you cannot publish any course, question, answer, comment, or other course content that violates local or national laws. You are solely responsible for any course, content, and actions you publish through our platform and services, and the consequences thereof. Be sure to understand all copyright limitations set forth in the instructor terms before submitting your course for publication on mbtelm.com.
If we become aware that your course or content is illegal or infringes on the rights of others (for example, if it is determined that it violates the intellectual property rights or rights of publicity of others, or is related to illegal activity), if we discover that your course or conduct violates our trust and safety guidelines, or if we believe that your course or behavior is illegal, inappropriate, or intolerable (for example, if you impersonate another person), we may remove your course from our platform. Mbtelm.com adheres to copyright laws.
Mbtelm.com retains discretion in enforcing these terms and our trust and safety guidelines. We may limit your permission to use our platform and services or suspend your account at any time, with or without notice, for any reason or no reason, especially in the event of a violation of these terms, failure to pay any fees on time, requests from legal or governmental authorities, inactivity for an extended period, unexpected technical problems, if we suspect you are engaging in fraudulent or illegal activities, or for any other reason at our discretion. In the event of any termination, we may delete your account and courses and may prevent further access to our platforms and services. Your course may still be available on the platforms even after your account has been closed or suspended. You agree that we will have no liability to you or any third party for terminating your account, deleting your course, or blocking your access to our platforms and services.
If a user has published a course that infringes your copyright or trademark rights, please inform us. Our instructor terms require instructors to comply with the law and respect the intellectual property rights of others.
You retain ownership of the content you publish on our platform, including courses. We are permitted to share your course with anyone through any media, including promoting it through ads on other websites.
Your course, as a student or instructor (including the lecture), remains your property. By adding lecture and other courses, you grant Mbtelm.com the right to use and share it, but you do not lose any ownership rights you may have over your course. If you are an instructor, be sure to understand the course licensing terms specified in the instructor terms.
When you publish your course, comments, questions, and ideas, and when you submit ideas and suggestions for new features or improvements to us, you grant Mbtelm.com the permission to use, share, distribute, and promote this course with anyone, in any platform and media, and to make any changes or edits that we deem appropriate.
In legal terms, by submitting or publishing a course through our platforms, you grant us a worldwide, exclusive, royalty-free license (with the right to sublicense to others) to use, copy, reproduce, process, adapt, edit, publish, transfer, display, and distribute your content (including your name and image) in any and all media or distribution methods (whether now known or later developed). This includes providing your course to other companies, organizations, or individuals that collaborate with Mbtelm.com for the publication, broadcasting, distribution, or release of courses in other media, as well as using your course for commercial purposes. You also waive any privacy, publicity, or similar rights related to all these uses to the extent permitted by applicable law. You represent and warrant that you have all rights, power, and authority necessary to license us to use any course you submit. You further agree to all these uses of your course without receiving any compensation or fee.
You are not permitted to engage in any of the following actions while accessing or using the Mbtelm.com platform and services:
Anyone can use Mbtelm.com to create and publish courses, and we enable instructors, students, and learners to interact for teaching and learning. Like other platforms where individuals can publish content and engage, things can sometimes go wrong, and you use Mbtelm.com at your own risk.
Our platform model means that we review courses for legal issues.
These terms are like any contract and contain important legal disclaimers that protect us from countless events that could occur, clarifying the legal relationship between you and us.
By registering, purchasing, accessing, or using our services, you agree to enter into a legally binding contract with Mbtelm.com. If you do not agree to these terms, do not register, purchase, access, or generally use any of our services.
If you are an instructor accepting these terms and using our services on behalf of a company, organization, government, or any other legal entity, you represent and warrant that you are authorized to do so.
Any version of these terms provided in a language other than Dari is for convenience, and you understand and agree that the Dari language version will prevail in the event of any conflict.
These terms (including any agreements and policies linked to these terms) constitute the complete agreement between you and us (which includes, if you are an instructor, the instructor terms).
If any part of these terms is deemed invalid or unenforceable by applicable law, that provision will be interpreted to achieve its closest original intent, and the rest of these terms will remain in full effect.
Even if we delay in exercising our rights or do not enforce our rights in a particular instance, it does not mean that we are waiving our rights under these terms, and we may choose to enforce them in the future. If we decide to waive any of our rights in a specific case, it does not mean we are waiving our rights generally or in the future
Our platform may experience downtime, whether for scheduled maintenance or due to site issues. One of our instructors may provide misleading information in their course. We may also encounter security issues. These are just a few examples. You agree that you will have no right to claim in any of these instances of malfunction. Legally and more comprehensively, services and their courses are provided on an "as is" and "as available" basis. We (and our affiliates, suppliers, partners, and representatives) make no representations or warranties regarding the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the services or their content, and expressly disclaim all warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We (and our affiliates, suppliers, partners, and representatives) do not guarantee that you will achieve specific results from using the services. Your use of the services (including any courses) is entirely at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
We may decide at any time and for any reason not to provide certain features of the services. Under no circumstances will Mbtelm.com or its affiliates, suppliers, partners, or representatives be liable for any damages resulting from such disruptions or lack of access to those features.
We are not responsible for any delay or failure to perform any of our services due to events beyond our reasonable control, such as acts of war, hostility, or sabotage; natural disasters; power, internet, or communication outages; or governmental restrictions.
There are risks involved in using our services; for example, if you access health and wellness content such as yoga and injure yourself. You fully accept these risks and agree that you will have no right to claim for damages even if you suffer losses from using our platform and services. Legally and more comprehensively, to the extent permitted by law, we (and our group companies, suppliers, partners, and representatives) will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of information, income, profits, or business opportunities, or personal injury or death) under any circumstances, whether arising from contract, warranty, tort, product liability, or otherwise, even if we were aware of the possibility of such damages in advance.
If you behave in a way that causes a legal problem for us, we may take legal action against you. You agree to indemnify, defend (if we request), and hold harmless Mbtelm.com and our group companies, as well as our officers, directors, suppliers, partners, and their representatives from any claims, demands, losses, damages, or costs of third parties (including reasonable attorney's fees) resulting from: (a) content you submit or provide; (b) your use of the services; (c) your violation of these terms; or (d) infringement of third-party rights. Your obligation to indemnify will survive the termination of these terms and your use of the services.
When these terms refer to "Mbtelm.com," it refers to the entity of Mbtelm.com you are contracting with. If you are a student, the governing law and the jurisdiction generally depend on your location.
You and we agree that there is no joint venture, partnership, employment, contractor, or agency relationship between us.
You may not assign or transfer these terms (or the rights and licenses granted under them). For example, if you registered an account as an employee of a company, your account cannot be transferred to another employee. We may assign these terms (or the rights and licenses granted under them) to any company or person without limitation. Nothing in these terms creates any rights, interests, or benefits for any third party. You agree that your account is non-transferable, and all rights related to the account and other rights under these terms shall terminate upon your death.
If a dispute arises, our technical team is happy to help resolve the issue.
Most disputes can be resolved, so please contact our technical team first before filing a formal legal claim.
Mbtelm.com is committed to using its best efforts to resolve disputes with its users without the need for formal legal claims. If a problem arises between us, you and Mbtelm.com agree to first work toward reaching a fair and equitable solution for both parties using the informal mandatory dispute resolution process described below.
From time to time, we may update these terms to clarify our practices or reflect new or different practices (such as when we add new features), and Mbtelm.com reserves the right to amend and/or change these terms at its discretion at any time. If we make significant changes, we will notify you using conspicuous means, such as sending an email notification to the email address specified in your account or by posting a notice through our services. Amendments will be effective from the day they are published unless stated otherwise.
Your continued use of our services after the changes take effect means you accept these changes. Any revised terms will replace all previous terms.
